Terms of Service
Acceptance
Section titled “Acceptance”These Terms of Service (the “Terms”) are a binding agreement between you (the “Customer”) and Obscur Systems LLC (“Obscur”, “we”, “us”), the operator of the Anthracite platform. By creating an account or provisioning an instance, you agree to these Terms. If you are agreeing on behalf of an organization, you represent that you have the authority to bind it.
The service
Section titled “The service”Anthracite is a managed database platform. You provision, scale, and operate Valkey, Postgres, OpenSearch, and other engines from a single web control plane. There is no free tier: every instance is a paid, self-serve resource. We operate the underlying infrastructure; you remain responsible for the data you store and the applications you connect to it.
Accounts and access
Section titled “Accounts and access”Access requires a verified email address. You are responsible for safeguarding access to your account and for all activity that occurs under it. Provide accurate account and billing information and keep it current. Notify us promptly at support@anthracite.dev if you suspect unauthorized access.
Acceptable use
Section titled “Acceptable use”You may not use Anthracite to:
- violate any law or infringe the rights of others;
- store or transmit malware or other harmful code;
- probe, scan, or attempt to breach the platform’s security or another customer’s isolation;
- resell or provide the service to third parties, except as part of your own application; or
- place load that degrades the platform for other customers.
We may throttle, suspend, or terminate instances that threaten the stability or security of the platform.
Plans, billing, and payment
Section titled “Plans, billing, and payment”Instances are billed according to the engine, size, and region you select, plus any metered usage, at the prices shown in the control plane. Fees are non-refundable except where required by law, and you are responsible for applicable taxes. We may change prices on at least 30 days’ notice; changes take effect at your next billing cycle.
Your data
Section titled “Your data”You retain all rights to the data you store in your instances (“Customer Data”). We process Customer Data only to provide and secure the service, as described in our Privacy Policy. You are responsible for the lawfulness of the data you store and for maintaining your own backups in addition to any platform snapshots.
Availability and support
Section titled “Availability and support”We target high availability and publish maintenance and incident information in the control plane. Planned maintenance may briefly affect instances; we aim to schedule it to minimize impact. Support is provided by email at support@anthracite.dev. Any specific availability commitments are set out in your plan.
Suspension and termination
Section titled “Suspension and termination”You may cancel at any time from the control plane; cancellation stops future charges but does not refund the current period. We may suspend or terminate access for breach of these Terms, non-payment, or risk to the platform or other customers. On termination, you will have a limited window to export Customer Data, after which your instances and their data are permanently deleted.
Disclaimers
Section titled “Disclaimers”Except as expressly stated, Anthracite is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
Section titled “Limitation of liability”To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our aggregate liability arising out of these Terms is limited to the fees you paid for the service in the twelve months before the event giving rise to the claim.
Changes to these Terms
Section titled “Changes to these Terms”We may update these Terms from time to time. Material changes will be announced in the control plane or by email before they take effect. Continued use after the effective date constitutes acceptance.
Governing law
Section titled “Governing law”These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Wyoming have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief in any court of competent jurisdiction.
